Terms of Service

These Terms of Service ("Terms") govern your use of the Money with Moana application ("the App"), provided by My Bookkeeper Moana (ABN 97 859 295 171), a registered BAS Agent. By creating an account or using the App, you agree to these Terms.

1. What the App is

Money with Moana is a personal budgeting tool that helps you track income, bills, and everyday spending, and estimate how much to set aside from each pay.

2. Eligibility and accounts

• You must be at least 18 years old to create an account.
• You're responsible for keeping your login details secure, and for all activity under your account.
• You must provide accurate information when creating your account.
• Each account is intended for one individual's personal use.

3. Acceptable use

When using the App, you agree not to:

• Copy, reproduce, reverse-engineer, decompile, or attempt to extract the source code of the App, in whole or in part;
• Scrape, crawl, or systematically extract data from the App;
• Use the App to build a competing product or service;
• Attempt to access another user's account or data without authorisation;
• Use the App for any unlawful purpose, or in a way that could damage, disable, or impair it.

We reserve the right to suspend or terminate accounts that breach these Terms.

4. Intellectual property

The App, including its design, code, branding, and content, is the exclusive property of My Bookkeeper Moana and is protected by copyright and other intellectual property laws. Nothing in these Terms transfers any ownership of the App to you. All rights not expressly granted to you are reserved.

5. Your data

You retain ownership of the financial information you enter into the App. By using the App, you grant us a licence to store and process that information solely for the purpose of providing the service to you, as described in our Privacy Policy.

6. Fees

The App is currently provided free of charge. We may introduce paid plans or features in the future. If we do, we'll clearly communicate any pricing before you're charged, and your continued use of any free features won't be affected without notice.

7. No warranty

The App is provided "as is" and "as available". We don't guarantee that it will be uninterrupted, error-free, or that calculations will always be accurate — you should use your own judgement and verify important figures independently. We're not liable for decisions made based on information from the App.

8. Limitation of liability

To the maximum extent permitted by law, My Bookkeeper Moana is not liable for any indirect, incidental, or consequential loss arising from your use of, or inability to use, the App. Nothing in these Terms excludes any consumer guarantee that cannot be lawfully excluded under Australian or New Zealand law.

9. Termination

You may stop using the App and request deletion of your account at any time by contacting us. We may suspend or terminate your access if you breach these Terms, or if we discontinue the App, with reasonable notice where practical.

10. Changes to these Terms

We may update these Terms from time to time. We'll update the "Last updated" date above when we do. Continuing to use the App after changes take effect means you accept the revised Terms.

11. Governing law

These Terms are governed by the laws of Australia. If you're using the App in New Zealand, nothing in these Terms limits any rights you have under New Zealand consumer or privacy law.
